{"id":41747,"date":"2026-05-18T12:26:02","date_gmt":"2026-05-18T10:26:02","guid":{"rendered":"https:\/\/labourinstitute.eu\/?p=41747"},"modified":"2026-05-25T12:32:29","modified_gmt":"2026-05-25T10:32:29","slug":"elmc-2026-a-practical-labour-inspection-perspective-on-posting-enforcement","status":"publish","type":"post","link":"https:\/\/labourinstitute.eu\/en\/elmc-2026-a-practical-labour-inspection-perspective-on-posting-enforcement\/","title":{"rendered":"ELMC 2026 \u2013 a practical labour inspection perspective on posting enforcement"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">One of the final workshop sessions of the second day of <a href=\"https:\/\/labourinstitute.eu\/en\/elmc2026\/\">ELMC2026<\/a> focused on the practical realities of posting inspections and enforcement in the field of cross-border services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The workshop \u201cTrust me, I\u2019m with Labour Inspection: Enforcement Practice &amp; Compliance Perspective\u201d was delivered by<a href=\"https:\/\/labourinstitute.eu\/en\/elmc2026\/#prelegenci\"> Agata Kostyk-Lewandowska<\/a> and <a href=\"https:\/\/labourinstitute.eu\/en\/elmc2026\/#prelegenci\">Sebastian Siemaszko<\/a> from the Polish Labour Inspectorate. Participants had a rare opportunity to look at posting inspections from the perspective of labour inspectors themselves \u2014 without myths, simplifications or purely theoretical assumptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the key conclusions of the session was the changing nature of both irregularities and inspections. As the speakers explained, the posting landscape has evolved from relatively straightforward and easily identifiable infringements towards increasingly sophisticated and professionalised structures. While outright criminality has become less visible, inspections themselves are becoming significantly more complex, resource-intensive and time-consuming.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the key challenges discussed were the growing number of letterbox companies, often established by third-country nationals, persistent cases of illegal employment involving non-EU employers posting workers to Poland, and the increasingly blurred distinction between business trips and posting of workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Particular attention was also paid to the practical difficulties faced by labour inspectors. The Polish Labour Inspectorate currently observes an approximately 40% increase in complaints \u2014 many of them lengthy and AI-generated \u2014 which further complicates and prolongs inspection procedures.
