Marcin Kiełbasa PhD at IMISCOE Conference on unequal treatment of third-country nationals posted to Germany

The 20th annual IMISCOE conference, co-organised by, among others, the Centre for Migration Research (CMR) of the UW and the Centre of Excellence in Social Sciences, took place from 3-6 July 2023

Marcin Kiełbasa PhD, took part in a panel entitled 'Posting of workers in the EU and inequalities' as part of one of the largest international conferences on labour law and immigration issues - '20th IMISCOE MIGRATION AND INEQUALITIES. In search of answers and solutions'. Moderated by the renowned researcher on the posting of workers in the EU, Frederic De Wispelaere of HIVA-KU Leuven, the panel also included other experienced experts in the field - Marco Rocca PhD (CNRS - University of Strasbourg), Sonila Danaj (European Centre for Social Welfare Policy and Research, Vienna) and Lynn De Smedt (HIVA-KU Leuven).

During this panel, M. Kiełbasa PhD, presented a speech entitled 'Access to the German labour market of posted third-country nationals: unequal treatment as a result of "the Vander Elst visa". In his presentation on this one of the key issues of labour mobility in the European Union, he discussed the German legal framework for the so-called 'Vander Elst visa' and how these regulations are applied in national judicial practice. There was also an assessment of these regulations and their application practice from the perspective of EU law and CJEU case law, as well as recent examples of cases before the Court of Justice. The Court's jurisprudence, including recent cases, offers hope for change in this important area.

Co-organised by, among others, the Centre for Migration Research (CMR) of the UW and the Centre of Excellence in Social Sciences, the 20th annual IMISCOE conference held in Warsaw this year is one of the largest conferences on labour law and immigration issues on an EU scale. IMISCOE, in turn, is the largest international network of labour and immigration law experts. In this year's edition, more than 1,000 experts from all over the world took part in dozens of panels.
